2. Scope and Applicable Data Protection Law

This privacy policy explains how we process personal data when you visit our website, order products, use a customer account, fill out forms, receive marketing communications, or otherwise interact with us.

Processing is carried out in accordance with the Swiss Data Protection Act (DSG). Insofar as the General Data Protection Regulation of the European Union (GDPR) or other data protection regulations are applicable, we also take their requirements into account.

We process data primarily for contract fulfillment, to meet legal obligations, based on legitimate interests in the secure and economic operation of the shop, and based on your consent, where required.

3. What data we process

Depending on usage, the following data may be processed:

  • Contact and identification data such as name, email address, phone number, billing and shipping address;
  • Order and contract data such as products, order number, price, delivery status, returns and refunds;
  • Payment and transaction data such as payment method, payment status, and fraud checks;
  • Customer account data and saved settings;
  • Communication data from emails, contact forms, and support requests;
  • Technical data such as IP address, browser, device, operating system, language, referrer, timestamp, and pages accessed;
  • Cookie, consent, analytics, and advertising data;
  • Newsletter and marketing preferences.

4. Shopify as shop and hosting platform

Our online shop is operated via Shopify. Shopify provides hosting, shopping cart, checkout, customer accounts, order management, security features and other technical shop functions.

Data may be transferred to Shopify International Limited and other Shopify companies or subcontractors. Shopify processes data partly on our behalf and partly for its own purposes, as described in Shopify's privacy policy.

Shopify may process technical usage data, cookie and device identifiers, order, contact, and payment information as far as this is necessary for the provision, security, and further development of Shopify services.

5. Orders, Payments, Shipping and Returns

To process an order, we use your data to conclude the contract, process payment, ship the goods, communicate the order status, and handle returns, complaints, and refunds.

Payments are processed via the payment services displayed at checkout. These may include Shopify Payments, Shop Pay, Apple Pay, Google Pay, and other payment providers offered there. The chosen payment service provider receives the information necessary for payment and fraud prevention. Complete card information is generally processed directly by the payment service provider and is not fully disclosed to us.

For shipping and returns, name, address, contact, and order data may be transmitted to shipping, fulfillment, and logistics service providers.

Processing is carried out for contract fulfillment, to comply with legal retention and proof obligations, and to prevent misuse and fraud.

6. Contact Forms, Customer Account and Protection Against Misuse

If you contact us via form, email or telephone, we process the information you provide to answer your inquiry, to initiate a contract, or to process an existing contract.

When using a customer account, Shopify processes the data required for registration, login, account management, and order overview.

To protect forms and shop functions from spam, automated access, and misuse, security and verification mechanisms from Shopify, as well as, if activated, Google reCAPTCHA or comparable services, may be used. In doing so, technical data such as IP address, device and browser information, and interaction data may be processed.

7. Email Communication and Newsletters

Transaction-related emails, such as order, shipping, return, or security notifications, are sent via Shopify or the email service activated in the shop.

We send newsletters and promotional emails only where legally permissible or if you have given your consent. In this process, email address, consent status, sending, opening, and click data may be processed to measure the delivery and effectiveness of communications.

You can unsubscribe from newsletters at any time via the unsubscribe link in the message or by sending an email to info@eg-gue.ch. Contractually required messages will still be sent to you regardless.

8. Cookies and Consent Management

Our website uses cookies and similar technologies. Technically necessary cookies enable, in particular, shopping cart, checkout, login, security, fraud prevention, and saving of your privacy settings.

Analytics, personalization, and marketing technologies are only used insofar as this is permissible under applicable law and required consent has been granted via the cookie or consent management tool integrated into the shop.

You can change or revoke your selection via the cookie banner or the shop's privacy settings. Additionally, you can delete or block cookies in your browser. This may restrict individual functions.

9. Google Analytics 4

We use Google Analytics 4 (GA4), an analytics service from Google, to evaluate the reach, usage, technical performance, and order processes of the online shop.

GA4 can process page views, sessions, approximate location data, device and browser information, referrers, interactions, and conversion events. For users from Switzerland, the EU, and the United Kingdom, Google Analytics, according to Google, does not log or store individual IP addresses; the IP address is discarded before logging.

The previous Universal Analytics function _anonymizeIp() is not part of this GA4 configuration and is no longer described as an employed technology in this statement.

If consent is required, GA4 will only be activated after your consent via the consent management. You can withdraw your consent at any time via the cookie settings.

10. Google Ads and Google Merchant Center

We use Google Ads for running and measuring advertising. Conversion tags, remarketing functions, and, if activated and permissible, Consent Mode or enhanced conversion functions may be used.

We use Google Merchant Center to transmit and manage product and shop information for Google services, particularly product displays, free listings, and Shopping ads.

When interacting with Google ads or Google product listings, Google and we may process information about clicks, devices, page views, orders, and conversions. Personal or pseudonymous advertising data is only transmitted within the scope of the activated settings and the given consents.

11. Meta Pixel and Conversions API

For advertising on Facebook and Instagram, we use, if activated, the Meta Pixel and the Meta Conversions API. These technologies help us to deliver ads, build target audiences, and measure purchases and other conversion events.

Browser and device data, cookie or event identifiers, visited pages, shopping cart and order events, as well as, if configured, hashed contact information, may be transmitted to Meta. The Conversions API can transmit server-side events via Shopify or a connected Meta integration.

If consent is required, activation only occurs after your agreement. You can change your selection via the cookie settings.

12. Third-Party Apps and AVADA SEO Suite

We may use Shopify apps and other service providers to provide functions such as search engine optimization, product display, analysis, advertising, customer communication, reviews, security, or automation.

In the active shop configuration, the AVADA SEO Suite is used, among others. This app supports technical SEO functions and can process shop content, metadata, and technical information for this purpose. The scope and purpose depend on the respective activated app functions.

Other apps only receive the access rights necessary for their respective functions. Since app configurations can be changed, this privacy policy will be adapted in the event of significant changes.

13. Recipients and International Data Transfers

Personal data may be disclosed, in particular, to Shopify, payment service providers, shipping companies, IT and security service providers, email services, analytics and advertising platforms, consultants, and competent authorities, as far as this is necessary or legally permissible.

Some service providers process data outside of Switzerland or the European Economic Area, particularly in Canada or the USA. If there is no legally recognized adequate level of data protection, we or our service providers use suitable safeguards, such as standard contractual clauses, contractual data protection obligations, or other permissible transfer mechanisms.

We do not sell your personal data.

14. Storage Duration

We store personal data only as long as necessary for the respective purpose, contract fulfillment, security, fraud prevention, or legal retention and proof obligations.

Order, invoice, and accounting data may be retained longer in accordance with legal obligations. Consent and marketing data are stored until revocation or until necessary proof periods expire. Thereafter, data is deleted or anonymized, unless another legal basis exists.

15. Your Rights

Depending on applicable law, you have the right to information, rectification, erasure, restriction or objection, and, where provided, data portability.

You can revoke any given consent at any time with effect for the future. You can object to processing for direct marketing purposes at any time.

You can also lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) or, if the GDPR is applicable, with the competent European data protection supervisory authority.

16. Data Security

We and our service providers take appropriate technical and organizational measures to protect personal data from loss, misuse, unauthorized access, alteration, or disclosure. However, a completely risk-free data transfer or storage cannot be guaranteed.

We update this privacy policy when legal requirements, services used, or data processing significantly change. The version published on this website applies.
